The Government of Bermuda recently advised that persons who hold a British Overseas Territories Citizen (“BOTC”) passport but do not also possess Bermudian status under the British Immigration and Protection Act, 1956 will not be entitled to visa-free travel to the US. This advisory was given after such a holder was denied entry into the US. A statement clarifying the position was issued by the US Customs and Border Protection Agency as follows: “In accordance with US law, only Bermudians can travel visa free. If someone is using a BOTC passport but is not Bermudian, they will not be allowed to travel to the US visa free. They have to present a passport from their Country of citizenship and a valid visa to travel.”
